On October 3, 2016, British Columbia released the highly anticipated regulations accompanying the newly enacted Franchises Act, S.B.C. 2015, c. 35 (the Act). As important, all readers should note that British Columbia’s first franchise legislation will officially come into force on February 1, 2017.
Last year, we commented on the introduction of the original Bill which provided guidance on the direction of the new franchise statute. Now, with the publication of a final draft of regulations, we are already under way with the process of analyzing the new law to determine how the regulations will impact franchisors’ existing disclosure obligations in Canada.
