Advertising & Marketing

The Cassels Brock Advertising & Marketing Group represents a diverse range of clients, including:

  • National retailers
  • Franchisors
  • Consumer goods manufacturers and distributors
  • Publishers
  • Ad agencies
  • Marketing and promotional companies
  • Television networks
  • Lotteries
  • E-commerce companies
  • Pharmaceutical companies

We advise and represent our clients bilingually in all areas of the advertising and marketing industry, including:

  • Misleading advertising - ad copy clearance
  • Contest rules - development and review
  • Promotional allowance programs
  • Consumer packaging and labelling issues
  • "Gray" marketing issues
  • Consumer protection legislation
  • General advice on regulatory issues affecting the sale of goods and services in Canada

We have helped to structure different types of contests on behalf of well-known marketing companies and consumer goods producers. We render this advice and draft the resulting rules on an expedited basis.

We also help our clients to design and implement crisis management procedures, as in product recall situations, for example.

We review advertisements appearing in all types of media and evaluate them for misleading advertising compliance in addition to any other industry specific regulatory requirements, often calling on our own expertise and that of our colleagues in the Competition Law Group.

Working with our Commercial Litigation Group, we act on behalf of trade-mark and copyright owners to enforce their rights by stopping the sale of "gray" and counterfeit goods in Canada. We work with many different manufacturers to evaluate their product packaging and labelling prototypes before production. We advise foreign companies generally on the regulatory aspects of doing business in Canada.
