ProfileLorne SilverLorne discovered the “highs” of litigation in his articling year. Since that time, he has focused exclusively on honing his advocacy skills. Over 20 years after first experiencing the thrill of the courtroom, Lorne continues to relish all aspects of dispute resolution, whether through commercial litigation, arbitration, mediation or negotiation. Lorne maintains a full commercial litigation practice. His strengths lie in his ability to comprehend complex legal and factual issues and to fashion and implement effective dispute resolution strategies. He is able to combine these strengths with full knowledge of all aspects of the various advocacy processes allowing him to represent his commercial clients effectively and efficiently in all aspects of dispute. Moreover, Lorne has a particular ability to deal with people and to understand their individual problems and concerns. This allows him to effectively communicate with his clients as to substantive issues of fact and law, process, likely result and cost. In terms of accomplishments, Lorne has a history of appearances and successes within all levels of the Ontario Courts, the Federal Court Trial Division, and the Supreme Court of Canada (successful counsel in Madsen Estate v. Saylor (2007 SCC 18), a May 2007 decision determining the application of presumptions of law in the context of estate disputes). His litigation experiences span the broadest range of commercial litigation matters but primarily include shareholder disputes and remedies, securities litigation, debtor/creditor rights and issues, contract disputes and employment law. During his 20-plus years at Cassels Brock, Lorne has served on many of the firm’s significant committees. Lorne is the past Deputy Managing Partner of the firm.
