Janine Kovach

Janine has been practicing exclusively in the construction law area for 24 years. Her practice is largely “owner” based, in that she provides advice to owners during the life of a project and develops standard form contracts. She assists owners with their own claims as well as with delay claims made by contractors and claims for additional fees made by consultants. She also addresses construction liens, errors and omissions of professionals, bonding and project close out.

A few examples of Janine’s recent work in these areas include:

  • Negotiating and drafting RFP and tender documents and construction contracts.
  • Working to resolve contract claims, negligence claims, delay claims and construction liens.
  • Providing “day to day” advice in relation to a construction project.
  • Dealing with insolvency and bonding issues.
  • Representing several clients with their build programs such as the University of Toronto, several school boards, a large national retail chain, a theatre chain and a large general contractor.
  • Representing errors and omissions insurers of design professionals.

Recognized as a leading practitioner in construction law, Janine speaks frequently to various trade associations and lawyers about contract issues, the Construction Lien Act, tendering issues, risk management and other topics. She is the author of several articles featured in construction industry publications. Janine is listed in the Lexpert Directory of lawyers in Canada under Construction Law, as Consistently Recommended.
