David Budd

David is a partner in the Financial Services Group. His practice is devoted to general business law, with an emphasis on corporate finance matters including secured, unsecured and project financing, bankruptcy and insolvency, business reorganization and the purchase and sale of businesses.

David has acted extensively for financial institutions on domestic and cross-border secured and unsecured loans, as well as syndicated and subordinated financings. He has also acted for many corporations, partnerships, limited partnerships and individuals on a variety of debt and equity transactions.

David has extensive experience in sports related law having provided advice with respect to the acquisition and financing of professional sports franchises. In addition, David has experience with respect to financing (both as counsel to lenders and borrowers) a broad range of industries including retail, retirement lifestyle, transportation, recycling and waste management, financial services, software and hospitality.

A few of his recent notable projects include:

  • Acting for the Federal Government of Canada, through Industry Canada, in connection with the restructuring of General Motors — the transaction involved over US$12.5 billion of new Canadian Government financing and included a number of extremely time-sensitive issues, including cross-border insolvency, M&A, financing and litigation.
  • Acting for Ottawa Senators Hockey Club with respect to the financing of the NHL Team and Scotiabank Place.
  • Acting for the Administrative Agent and a cross border syndicate of Lenders with respect to a $265 million financing of an NHL franchise and arena.
  • Acting for the Administrative Agent and syndicate of Lenders with respect to a $150 million construction financing for an international hotel chain.
  • Acting for JP Morgan with respect to the financing of Porsche Financial Services.
  • Acting for a major Canadian transportation company with respect to its $30 million senior facility and $75 million term facility.
  • Acting for a Schedule I Bank with respect to its cash management products and services.
  • Acting for Canadian subsidiary of an international car rental company with respect to a US$975 million global financing and general corporate matters.
  • Acting for Sony BMG with respect to general corporate matters.

While at law school, David received the Reuben Wells Leonard Prize for obtaining the highest standing in International Law.
