In its decision, the Divisional Court affirmed the Ontario Municipal Board's jurisdiction to determine who is a proper applicant under the Planning Act, and therefore who has standing to file an appeal. The decision paves the way for the Board to hear appeals on behalf of Nyon Oil to facilitate the development of 725 acres of land for an energy park to serve southern Ontario and western New York State. |
