What must one do to put a combined heat and power project into operation? Depending on whether the project will be under provincial or federal jurisdiction, the constraints are many, but they are surmountable. Knowledge of these requirements is essential in order to prevent delays in commissioning and to stay on budget.  

  • Federal or provincial jurisdiction?
  • If federal, Canadian Environmental Assessment Act (CEAA) and SOR 97-181
  • If provincial, rules differ in detail province to province but requirements are similar
  • Ontario's Green Energy and Green Economy Act (GEA)
  • Electricity Act, 1998 (EA); Ontario Energy Board Act, 1998 (OEBA)
  • GEA definitions
  • CHP is a "generating facility" under GEA and EA
  • CHP can also be a "renewable energy generation facility" under GEA, if fuel is biomass, biogas or biofuels
  • Subject to OMNR Approval and Permitting Requirements Document for Renewable Energy Projects; bases
  • Subject to MOEI's Renewable Energy Approval Regulation under Ontario's EPA; bases
