TransactionsJail Time for Contemptuous Infringement Following Receipt of Injunction Order by EmailPublished: 02/14/2006 By Emily Larose The plaintiffs brought an application before the Federal Court to find the defendants Radiopol Inc. and Jaroslaw Bucholc in contempt of court for having inter alia continued to infringe the plaintiff’s copy-right and trade-marks contrary to an earlier interim injunction. The plaintiff, Telewizja Polsat S.A., is a Polish producer of television programs and the owner of the POLSAT 2 International television signal (Polsat Signal) and the plaintiff Telewizja Polska Canada Inc., has the exclusive right to distribute the Polsat Signal in Canada. The corporate defendant was fined $25,000 and the personal defendant was fined $10,000. The personal defendant was also sentenced to a six-month term of imprisonment, which would be suspended if, within five days from the service of the Order, the defendants took down the internet site at www.trpol.com.
