Cassels Brock Successfully Resists Application for Leave to Appeal to the Supreme Court of Canada

Published: 03/22/2010

By Joseph J. Bellissimo

The Calgary Airport Authority sought leave to appeal to the Supreme Court of Canada to challenge AerCap Group Services Inc.'s repossession of an aircraft leased to Zoom Airlines just hours before the Calgary Airport Authority obtained a Court Order for seizure of the aircraft. Don Gray (Aerospace), Carlo Vairo (Aerospace), and Joe Bellissimo (Aerospace/Restructuring) acted for AerCap in connection with the aircraft repossession and as instructing counsel in the subsequent litigation before the Alberta Courts. Joe Bellissimo also acted as co-counsel with Burnet Duckworth & Palmer LLP in Calgary in connection with contesting the Calgary Airport's application for leave to appeal to the Supreme Court of Canada, which was denied with costs on March 18, 2010.
