Newsletter ArticleTrade-marks North of the Border PodcastPublished: 05/10/2011 By John McKeown John McKeown, partner in the Advocacy group of Cassels Brock, recently participated in a Martindale.com podcast. Entitled “Trade-marks North of the Border”, he answered questions about trade-marks in Canada, both from the viewpoint on Canadian firms and foreign-owned firms. While registration of a trade-mark provides public notice of exclusive rights to a logo or phrase, it can also protect future use of same. If a foreign-owned company intends to carry out business in Canada, the registration of a trade-mark will protect its use until it is implemented here. McKeown states that the trade-mark issue is very much a marketplace driven one and that registration of a trade-mark is an important part of doing business. The accompanying article Protecting Trade-marks North of the Border explains to practitioners and other interested individuals outside of Canada how Canadian laws relating to trade-marks work so they can use this information strategically to their advantage. |
